They will most likely first send a notice as an olive branch to the funder to see if this can be worked out without having to take on the heavy burden of litigation. My first question, as an attorney myself, is did you have a Participation Agreement with the Funder?

Lol, I just have to set the record straight here, a lot of people are confused, and to be blunt, couldn't be more wrong. I have been funding with Splash for a long time and am very familiar with how they do business. The reason deals get back doored is because of the lenders, not Splash. Splash would funneling business right out the door, and they do WAY too big of numbers to try to tarnish their entire business model. Splash is one of the largest players in the game and in order to get certain deals done, they sometimes go to higher risk funders. You see Splash deals because certain lenders are backdooring them. When it comes to lower level files, that's the way this business is, but with larger files Splash has the best pricing options in the industry and is in each Tier 1's top 5-10 ISO's, even if you are signed up directly you won't receive the rates/offers that Splash does. These smaller lending shops are pushing deals out the backdoor because they can't fund them first hand. Period.
