UPDATE:

So we were able to advance 25% of the Hard money loan and the remaining $1.5M is being held in escrow until Roc removes their UCC.
Maria Catalano has been extremely unhelpful and started playing the victim that we are harassing her. It seems they have no intention of removing the UCC.

Does anyone know what recourse we can take to get this removed? The whole company is a ghost and inaccessible

Have the business owner file a UCC-3 or reach out to a lien attorney. PM if you need more help with this. I have legal contacts.

How can the business owner put a ucc3? doesnt it have to be removed by the one who put it on (rok)?

There's a process to filing the UCC3 for the business owner and depends on the state, and especially if they can provide documentation that the lien is no longer valid (payoff letter). I have been involved with such cases several times. Some states require a 30-day wait to verify.

I can say with almost 100% certainty that it is ROC
