Sounds like Debtor In Possession (DIP) financing, which requires court approval.

You can't take a loan out when your in Chapter 11 without Court approval - do you have a Motion to authorize the DIP financing? What were the terms the court authorized?

Instead of guess why not contact a company that has experience in DIP financing such as us and a few other companies in this thread. Over the years I've seen urban legend run rampant through folks who just don't know the facts.
We are prepared to petition the court to authorize financing of the debtor's accounts receivable.
