    What exactly do you want to see? Every company who doesn't allow stacking on their positions will show in the merchants contract.

    Are you wanting to know in order to assist a Merchant that has this in place or wanting to apply a "no stack clause" to your own deals? I hope not the second one.

    Why would having a no stacking clause be a bad thing? Most senior lenders are using them these days....

    If they are a "Funder" they should consult with a legal adviser- not DF. Even though senior lenders/funders are using "no stack clauses" that doesn't mean a broker knows which ones do and still solicit for additional positions. Most Merchants don't pay attention to their contracts or understand the term "stack" that we have- it's a B2B term, not a B2C term.

    Also- a Broker can't force a Merchant to only work with them and put a no-stack clause. Most partner agreements read that when a deal is funded- the client becomes "theres" and there is limited ways you can work with, solicit, or stack. Maybe that's the fine print they are looking for?
