Very Strange Phonecall From "Another Broker" - Blocked Number
I think filing after the fact puts your collateral at risk. You only have so long after a transaction to perfect your lien. If a judgement or other notice of lien is filed while you wait you may lose your lien rights.
I think you need to balance that out against the risk of notifying a stacket to pile on your transaction.
I don't think the industry has figured out what it wants to be when it grows up. Secured or unsecured party.

I agree with Bob. As a lender, I am absolutely going to file a UCC and protect my rights, especially since I am in first position. That stated, Jon brings up a good point. We need to notify our clients that all the sharks will start calling and they need to beat them off with a stick.

For everyone questioning the value of filing a UCC up front, there is a lot more to it then anyone on the forum has mentioned. Just wait for the Rapid lawsuits to play out, and then let's revisit.

How many Rapid lawsuits are there? Who's involved? I think the industry liked things better when the idiots at Rapid were busy suing each other. Back when Lee Jundanian and Jeremy Brown were busy robbing the stockholders and rapid had like an 80% default rate.
