Reccomendations for collection Lawyers/Agencies
Hey Guys,
Does anybody have recommendations for Lawyers to help with the collection side, mainly ACH deals?
Cash Advance is a risky business, just want to make sure the money comes back as quickly as it gets put out.

If you need something beyond actual collections (collections is phone calls and letters) such as filing lawsuits, I know a really good law firm with merchant cash advance specific expertise. They're also good if a merchant or ISO sues you or you need to sue an ISO. PM me for info.
For your big defaults where letters and phone calls aren't helping, you can easily win a judgment against the merchant.

Ill add that there are several strategies. We have tried many different outside firms with very few results. The only attorney that has successfully delivered results meaning collecting receivables fast is Anna Rubin 212.804.7012.
Receivables seized, interpreted in court and withheld: credit cards, ach processing , commercial receivables and medical.
Highly recommend understanding overall strategy, results only measured on what can be collected quickly and without putting good money after bad.

Good point chambo that happens to be my wife. I guess my opinion is a little subjective, but that said results matter the most. She happened to be a prosecutor for 5 years. Her last department as a DA was major rackets division prosecuting complex white color cases. Has an ability to comb through complicated transactions and get results. Trail is no objection if fraud or other misappropriations are present.
Again we have tried many outside firms nobody has collected period. Just today I witnessed her inter-plead funds in court through medical receivable of a insurance payer on one of our deals into a BK court. She will frieze funds and attach them to force the merchant into compliance when they are legitimately defaulting on agreement.
All these other strategies and law suites are to no avail even if you receive a judgement. Measure results on getting merchants to comply with agreement. We have an honor system with merchant as we buy future receivables from the merchant unless they default through fraud.
Measure defaults and collections through what you can collect in dollars from these accounts.
My two cents!!Last edited by Capital Stack; 03-05-2014 at 07:37 PM.

Protect yourself against whom? If you are brand new to the game and want to send your version of an ISO agreement out to funders....heh, well, good luck with that

yeah they're mediocre in their recovery tactics, charge 30% on recovered money which i guess is typical and then float your money for 30 days and cut a check once a month. if you ask me they're overloaded with files to really expedite anything but i guess again, that's typical for most debt recovery agencies in the MCA space.
