Is there anything to worry about with the Cali regulation & requirements for lender's license for MCA deals?
If not, does that include a cap or does it not matter?
I ask because I have tons of Cali UCCs I don't even like calling. Should just dial away?

To my understanding, if you are structuring the transactions as Cash Advances, Not loans, then you do not need a license for Cali.

Their is a little more into it that just MCA/loan, it also has to do with how the advance is funded. A few MCA funders (like SFS) actually require a CFLL because of how they charter funds.

Im not an attorney either but that doesn't stop me. lol Whats the question? If its a fixed ACH its viewed as an MCA. The broker would need to be licensed in CA. I believe even the funding company needs to be registered or certified to do business in CA.
