    This again comes down to "tortious interference"

    Courts in the past have made a distinct difference between legitimate competition and unlawful
    interference.

    These cases have been going on with loans...commercial lending for decades. 1st position, 2nd position.

    Most just had to prove they have a "lawful business interest"...certain jurisdictions have specific laws

    The Lender had to establish that they had a legitimate business purpose, not malice or “disinterested malevolence" which technically is an evil purposeful intent to harm.

    they have used this as a weapon to stop the seconds( loans) but Ive seen it be "summarily dismissed"

    Ive also seen someone come back with a malicious prosecution defense off of a baseless claim


    ( My experience is with commercial and residential lending in regards to these matters , not mcas)
