    I remember Sean Murray once mentioned a restaurant he was going to fund with a MCA back at MCC. The day before he was going to fund them he went in with his wife, and when it was time to pay he was told that the restaurant no longer accept credit cards.

    Ha, yes. The owners had never met me so we went there as anonymous diners. It was basically my final underwrite. They stopped accepting cards a day or two too early. The restaurant went out of business a few months later. It was a Brazilian steakhouse in midtown.

    one of my best was we where going to close a 100K plus deal with First Funds wife picked up the phone for interview and said husband is out since Tuesday on a bender when he sobers up i can have him call back! needles to say the killed the deal.

    I had a merchant go to her local bank and use to phone to call in "as the bank teller" to confirm the balance of the account...so we called the number back as we were suspicious and they confirmed that it had been the merchant.

    You can change the number you call from but not the way your voice sounds.

    And then when we confronted he she was denying it and said she wasn't at the bank but we had the branch manager on the other line and could hear her in the background.

    I am tired of this tortious interference argument. I am not a lawyer BUT I do Believe that in order to assert the tortious interference claim, a few things would have to have happened.

    You had an agreement/contract with a company and you are driving business away to a competitor behind their back..even if its for stacking purposes or

    You make false claims and accusations are made against a business or an individual's reputation in order to drive business away.

    or When an individual uses "tort" (a wrongful act) to come between two parties' mutual contract. ( slander, defamation, scare tactics, racketeering)

    There is a fine line as to what is a tortious act... Sprint cannot sue Metro pcs for having customers switch to them , or take out a second phone.
    Well I take that back..anyone can sue for anything.

    Their is something called frivolous damage. If someone was ever to do that to me and I did not enter into a contractual agreement with them to stay "loyal". Id slap them back with a frivolous damage suit and malicious prosecution.
    This "in my opinion" is a used as a scare tactic from bullies trying to keep their clients, or some personal vendetta. Or maybe good companies trying to get other companies from over extending clients and bankrupting them...who knows

    I do not stack my loans and preach against it to clients...doesn't stop them from going behind my back to another company.

    Can I claim tortious interference as well? What if my renewals get taken?

    I try to establish a good working relationship with my clients, and that's the only thing that's going to keep most of them loyal to me.

    Looks like Pearl's counter suit in NY was dismissed and they were told to resolve their differences in the original complaint filed in Maryland, "SMALL BUSINESS FINANCIAL SOLUTIONS LLC v. PEARL BETA FUNDING LLC"

    Maryland doesn't supply the filed dockets on their website, but a brief description HERE

    It appears Pearl's motion to dismiss was denied in 2016 but as of last month the case is still ongoing and from what I gather it may be going to trial?

    Anyone with access to PACER may be able to get better details.

    This again comes down to "tortious interference"

    Courts in the past have made a distinct difference between legitimate competition and unlawful
    interference.

    These cases have been going on with loans...commercial lending for decades. 1st position, 2nd position.

    Most just had to prove they have a "lawful business interest"...certain jurisdictions have specific laws

    The Lender had to establish that they had a legitimate business purpose, not malice or “disinterested malevolence" which technically is an evil purposeful intent to harm.

    they have used this as a weapon to stop the seconds( loans) but Ive seen it be "summarily dismissed"

    Ive also seen someone come back with a malicious prosecution defense off of a baseless claim


    ( My experience is with commercial and residential lending in regards to these matters , not mcas)
