I bet you the other First position shops are not happy about it, what happens to the industry when this gets thrown out like a dirty diaper left in a car in death valley on a real hot day with clear sinusus.

"Y'know, we sued SIX different funders, and only got two pages of comments on DF? I was told this was supposed to send shock waves through the industry! Fire and brimstone coming down from the skies! Rivers and seas boiling! Forty years of darkness! Earthquakes, volcanoes...The dead rising from the grave! Human sacrifice, dogs and cats living together... mass hysteria!"
This is a clear PR move....but perhaps they'll get damages too....or at least the attorneys will.

I've studied a lot on this topic, I've read Pepper Hamilton's numerous views on it too, Dealstruck will have a tough time winning this one (I think)

Can someone logically break down the merits of Suing a company that happens to advance capital to a merchant that already has other liabilities. (such as a cash advance)...

Likely they filed due to a high default rate. A startup does not incur this type of expense unless basically forced to so (a prudent one anyway). I imagine funding circle's is off the charts as well as lending club. There's a reason you don't give 3 year terms to SMEs.
