He should be OK. He can easily walk out of jail the same day and go commit another crime thanks to the lovely liberal idea of 'no cash bail' in NY. If you can assault a cop in broad daylight with video evidence and walk out less than 24 hours later, you can easily possess an assault weapon. Slap on the hand and maybe go into hiding or another country.
