Merchants aren't Googling the news cycles on MCAs.
Will this go to other funders? Sounds like Leticia wants publicity, so the smaller places probably aren't in her sights.
Most funders also don't have ex-underwriters and ex-funders telling her that they refuse to lower payments, because they don't.
Make sure that you have a reconciliations department, and don't get trolled by an undercover agent.

I have had merchants google the name they see on the contract and complain about negative press, can't imagine how the convo would go with this one. If you know your merchant won't then good luck with all sincerity, but I am not taking the chance on ruining something for no reason. Yellow always been a last resort to me and was barely worth it unless it was a hop

Yes, VERY bad idea to get Delta Bridge to fund anything at this point.
However, I heard from someone recently that their offices emptied out.
I expect a major wave of new funders to show up over the next several months.

I don't think that's going to happen, the ag is attempting to classify mca's as a loan not a purchase of future receivables if that ends up happening most lenders are ****ed.

The AG is not trying to classify Cash Advance as loans. Rather, AG is stating that Delta FKA Yellow was not issuing true cash advances. That while their contract may have appeared to be a PSFRA, it was actually (in practice) a criminally usirious loan. That the rules are clear when it comes to cash advance and that they seemed to have failed to follow any of them...

So if you have a recon. provision, a reasonable specified percentage (a high one makes the whole recon illusory), a well written contract, you focus on compliance and stay abreast of the legal landscape of alternative funding and employ good underwriting practices I believe you should be fine. One of the biggest issues with Delta/Yellow was their IFOs and their inability to control them (my opinion).
