Speaking of transportation..... I got my monthly list of bankruptcy filings yesterday. The list keeps getting bigger and bigger. There are some large announcements like Barney's, but the smaller company list is deep. There were a lot of retailers. I saw a staffing company that was a habitual stacker. The largest industry by far was trucking/transportation. I did some digging last night into the filings of some of these companies. The common theme: Small company, factoring or bank line, and stacked advances.

Seems like from that Stat banks will pull back and will increase the pool for alternative funders (is my take -- no pun intended) The list of new companies filing for business is ALSO increasing by Double Digits!! (similar to Mantis commissions)

Where did you find the stat of new business filings increasing? It would be interesting to see what industries are filing for new businesses and how much revenue is being made in those businesses. A lot of businesses are registered every year that produce zero income.
My bankruptcy stats come from a very reputable source where I pay a subscription for the service. I spoke with three reputable bankruptcy attorneys in Florida this morning. They are noticing the same trend regarding bankruptcies.Kevin Henry

Talking to some BK attorneys.... They are seeing more and more ABC cases rather than court filings. It is a much quicker and cost effective process. The amount of ABC cases is rising at a rate faster than BK.
Another note.... I have seen at least 10 out of formula ABL deals this week. The businesses had ABL lines with banks with aggressive advance rates on inventory/M&E. The businesses declined and tripped covenants. They were all financed out of traditional ABL formula. When they trip covenants.....it's Hotel California.Kevin Henry

Out of curiosity, how does looking at BK's or new business filings help you guys in the MCA world? I used to call new businesses constantly and found it was a waste of time for the very reason one of you mentioned above: it doesn't mean they have revenue. As for BK's ... does anyone really want to bother with insolvent companies and they headache of funding them?
I don't mean to sound disrespectful; just curious how this plays into funding deals.

Quickfunder,
We are not an advance company. We are asset based lenders and factors.
-New business filing data-It's not good information unless you can determine what if any revenue is being generated by the new entities. Again, a lot of non-revenue entities are started every day for a variety of reasons.
-BK- Monitoring them is important information as a lender, factor, funder, or equity inventory as it can be a good indicator of what is going on in certain industries. Digging into the filings is helpful as you can determine how some companies found themselves in CH11. As a factor, we provide DIP financing for companies in CH11.
Lot's of useful information....Kevin Henry
