    Are they illegal? Can we get sued for them for any reason?

    Marcus this might be the smartest thing I have ever heard you say.. I have to agree this forum is a useful tool for a lot of things, however legal advise not one of them

    You need to scrub your list against the DNC registry, and be extremely well versed in the TCPA before embarking on any telemarketing, let alone automated "press 1" campaigns or even outsourcing it to a 3rd party.

    There are people who literally make a living out of entrapping telemarketers who unknowingly violate TCPA. One such person set up a completely fake plumbing company and dozens of forwarding numbers and put himself on tons of marketing lists just for the purpose of threatening lawsuits and forcing people to settle with him -- see below excerpt from an email from a telemarketing provider.

    You have to give Fred and Andrew Heidarpour credit. They have quite a racket. Yes, as in racketeering. Somehow the Feds can't put two and two together. Give Fred a call at any one of his 29 company phone numbers and offer him funds and you'll get sued. Give Fred a call at any one of his company's 29 phone numbers for plumbing service, no one will come out.

    For your protection, these are all the numbers associated with Abante Rooter and Plumbing. Put them on your DNC

    by brokerfair legal panel i asked one of the lawyers and his answer was you got to be crazy . press 1 campaign highest risk after going thru algorithm of calling 0000000 than 00000001 etc , using a dailer next level of risk ,click to call lower level of risk . manual dailing lowest level of risk . how much can you make and is the risk worth it and be ready to settle outside of court with all .
    like marcus said we are not lawyers and you will want to speak to one

    Had it happen we had to settle for 10k...Merchant calls because we run his credit for an approval. We let him know we received an application from a broker he filled out for an advance. Merchants states he did not fill out any application and that it is fraud, we had a hand signed application we processed without verifying the signature. Had to settle with the merchant we discovered later we werent the only funder to settle with this merchant. Not sure if he is still doing this to lenders.

    Press 1 campaigns are a dying art that once was very effective but have been overused and exhausted as a successful form of lead generation (thanks Asia).

    To answer your question, yes, you can be sued.

    There are many other approaches that you can focus your time and energy on but if you’re hell-bent on running a P1 campaign, I highly advise not only to scrub against DNC but also a Litigator list.

    Yes, Robocalls are always illegal, You can scrub the list against National Do Not Call Registry.

    Also, I myself tried Press 1 Campaigns for one of our clients, never worked out. Spent $600 in 2 days, most of the calls I got wanted me to put them on DNC. The few interested merchants I got but 90% of them were not qualified.
