    Judgments worth anything?

    I come across files that have multiple Judgments filed on them (in form of COJs) and the businesses are coming around for more financing, as if nothing ever happened. My question is, how does a business operate as if nothing ever happened, after they default on multiple MCA funders, with active judgments against them? I've seen multi million dollar defaulted businesses, operate as usual.

    and this surprises you? Why do people with previous repossessions apply for a car loan? Why do people with credit card write offs apply for credit? You've never seen an application from someone who's defaulted on a previous MCA?

    If anything it seem your lead sources are top tier.

    It surprises me that the funders don't or can't enforce the judgements, and that the merchant walks away without paying a price (besides credit). Especially when the default is hundreds of thousands of dollars.

    A judgement is just an order by a judge to pay up, unless they try to levy their bank account.

    and if the merchant plays whack a mole with bank accounts, good luck locating them

    and.....as long as there is one company out there that'll fund a merchant with a judgment, this nonsense will continue.

    In other words, if no one would fund defaults the Merchants wouldn't do it?

    No....then the judgments would mean something to the merchants.

    If they can still get money from one of your competitors, what do they care if you file judgment against them?

    One would think that a judgement is a legal way to enforce payments, not only a threatening tool against future financing. For that you have a credit score. It's very troubling to me that the commercial judicial system is so weak in this country.

    Well, there was a day when, if you had a judgment, or a BK within 10 years, everyone and their mother declined you. Nowadays, due to competition,....and outright greed, people are saying "BK? NO PROBLEM? JUDGMENTS? NO PROBLEM!"
