Today, 04:55 PMPoint of sale company for bodega stores. Like any smart company, they are trying to capture all the revenue, like what Shopify does with loans. I believe they are only in the cash advance space when it comes to their clients.

Today, 04:27 PMI will say it again as i posted previously Goldenhippo. Im not here to argue or waste my time discussing the merits of the deal, I am here to let others know about how it transpired to avoid it themselves.

Today, 03:51 PMSounds like this deal is as good as the one Stormy Daniels ended up with: Daniels says she ended up with around $96,000 from deal after attorney and her agent took their fees After attorney Keith Davidson and her agent Gina Rodriguez took their fees, she ended up with “approximately $96,000,” she said. That's 26.2% in fees. And she would have to pay taxes on that as well.

Today, 03:38 PMWe never take a PSFs on MCA. We are primarily an A Paper/ Term Loan/ 7A shop deals of this sort are out of our wheelhouse. Client this case needed a 5th position and we explored various options, presented all options to the client who needed the funds immediately for payroll. At the end of the day the client agreed, signed and completed the deal to full RTR as agreed with no missed payments etc. However, youre not wrong. We should have done a better job vetting FND hence the purpose of my post on this thread to let others know to not make the same mistake. The purpose of the post was not to discuss the terms of the deal, albeit terrible.

Today, 03:33 PMThe first thing you can do is contact the bank about the unauthorized debits. The way it works is that the bank contacts the bank that did/authorized the pulls and the bank that authorized the pulls requests to see authorization from the puller. If they have contracts, then they let it go and then any "fraud" is up for a lawsuit. If they don't, then they will likely return the money.
-
Today, 03:31 PMYou brought FND the deal, you're responsible whether you like it or not. Instead of sending your deals to bs funders in long island, do your research next time. So because of your negligence, he is out a bunch of money from the nasty deal you got him, plus 51k for the over debits, lawyer fees, and his time wasted on this situation.

Today, 03:26 PMGood question, its a 40 year old Non profit run by 75 y/o+ directors using local/regional bank that likely doesnt use MFA/ 2FA.

Today, 03:23 PMIm not sure how a funder over debiting from a merchants bank account or a merchant not changing their bank login is negligence on my part. This is a merchant with 700k in revenue per month and hundreds of credits and debits in their ledger who has utilized MCA products for years this caught both of us off guard as ive never seen this happen in my 12 years of experience in the industry. When they caught it that is exactly what i advised them to do. But yes it will likely proceed to a lawsuit unfortunately.
-
Today, 03:12 PMYou could've have easily advised your merchant to a) call the bank and tell them to block this funder or b) change their password. From your story, it seems you were incredibly negligent.

Today, 02:39 PMThat is insane.... Simple lawsuit should have this guy dead to rights. Over-debiting is a huge problem with these BS high risk funders- make sure to change passwords especially when balance is paid off!!!!
-
Today, 02:38 PMJust a curiosity question - Why did the merchant not change their login credentials , plus nearly every bank I know of utilizes MFA - why not in this situation?

Today, 02:16 PMA heads Up to any ISOs/ Brokers out there. Run dont walk away from these guys. 12 years in this industry ive never seen a deal handled worse. Funded Client 25k deal with 30% origination, 25 day deal 1.499 payback 37,500. Upon completion of the deal and full RTR paid . Jacob Proceeded to use merchants login 40 days later and pull additional ACHS totaling 51k.. All while ignoring the merchants calls for 2 weeks while pulling ACHS. First excuse was its passover, second excuse was im sick, third excuse was you owe me 10k for stack ( Shocker. Client did not stack) . We have plenty of unethical people in this business but this was by far the most unethical conducting of business ive ever seen by an egregious measure. Oh and as for the max comission, of course it was never paid. Again proceed at your own risk but RUN dont Walk from FND.

Today, 11:36 AMAs a funder, we screen all of our brokers before signing them up. But the same should go both ways. As brokers, ask questions, don't submit anything until you've read over their ISO Agreement and it's fully executed. Please exercise caution in not only who is funding your file, but who gets to see your merchants' personal and financial information. I get people asking to send me deals all the time before screening, but I tell them to sign an agreement before doing so, for my protection and yours. I know everyone's obsessed with speed and turnaround in this industry, but sometimes you need to hold your horses just a little bit and act more prudently. An ounce of prevention is worth a pound of cure.

Today, 11:33 AMJust emailed you! our 1st position renewals work like a line of credit rather than refinancing the merchant over and over. Hopefully we can fund some good deals for you!
-
Today, 11:26 AMGoldenhippo has a good point. You got them into the mess and expect to get paid. As brokers, our job is to create a good relationship and we get paid when it gets consummated. Sounds like FND was a really bad deal, and the funder was really bad, and the merchant has somewhat of a right to blame you for finding and "vetting" them. I hope you didn't take a PSF.
