Why is this rule not being enforced?

Users with a free email address
Users registered with a personal email address such as gmail.com or equivalent may be allowed to register and participate on the Site, however the account will be publicly marked as being a "free email user." Such users may also be subject to tougher moderation restrictions to enhance accountability.
