Are there any direct funders in CA on this site?

I am wondering if you need a CFL license to fund advances nationwide if your entity is formed in CA. Thank you in advance.

I don't know about cash advance but in equipment finance a CFL license is only required to offer financing to borrowers in CA - you can still market to business owners in other states.

We can assist with placement for any equipment deals in CA, and of course other states.

Would it not be best to consult with a Lawyer in California that is well versed in the topic?

Dave, are you here just to be annoying, or are you here to be a value-add? Maybe, just maybe, there are California licensed brokers on this board who can help answer the question? Not every lawyer knows every law. What you just did with your post is say, "You're stupid, why are you asking?" Nobody likes to be friends with "that guy." I know, because in elementary school I was one of those guys, but I learned to play nicely with people and eventually grew up.

I think its your Hall-Way Monitor type responses that make your answers unpleasant. It just seems like you are quick to discourage people. Maybe not everyone wants to live like you, is that allowed?

This is a good site and resource from the DBO -

    https://dfpi.ca.gov/california-finan...law-about/#Who

    --
Who is Required to Obtain a Finance Lenders License?
In general, any person engaging in the business of a finance lender or finance broker in California is required to obtain a license under the California Financing Law. The California Financing Law contains a number of exemptions for persons licensed by other regulatory agencies.

    Definitions
“Finance lender” includes any person engaged in the business of making consumer loans or making commercial loans.
“Finance broker” includes any person engaged in the business of negotiating or performing any act as broker in connection with loans made by a finance lender. A broker license authorizes brokering of loans to licensed finance lenders; it does not authorize brokering of loans to those who are not licensed, finance lenders.

Everyone, please be nice to Yankeeman07. I am sure what he meant to say was that you should get an SBA 7A for your merchant and then do a credit card processing split.

What is discouraging or unpleasant" about suggesting to someone to consult a a Lawyer that is versed in the topic? It is a serious question , that requires a Legal Answer, not a bunch of opinions - which generally don't amount to a hill of beans.

The few $$$ invested may save the poster a huge amount of money in the long run. That's "unpleasant" ?

You must be referring to the SBA Loan we just closed for a merchant to purchase a self-storage facility - Loan size - just under $2 Million.
