Well very Interesting case here , One of my Accounts got a large Advance from Funding Circle not originated by us though and just like a lot of businesses during the Pandemic and this small business borrower’s merchants health issues they had a rough time but proactively structured a payment plan in place. Seems Funding Circle intentionally went off the agreed terms at top brass orders and crossed all lines. Its very well known how a lot of MCA / business Loan lenders will use not proper collection systems and harass merchants ,bash their credit, call their clients or anyone possible to make their life a living hell . We all know that MCA’s / business Loans have such high Rates and Short terms due fact Risk for lenders is very High and a certain default ratio is expected . FC does not consider themselves a MCA lender, yet what they did to this borrower went to a place even MCA’s would not go. This borrower decided to fight back. HEALTHYMOUTH LLC counter sued Funding Circle USA and Marketplace for $50 Million Dollars in Damages . The Borrower is a highly respected businesswoman from California and a former Attorney as well. I am very Interested on seeing how all this pans out and the Lawsuit evolves .

a quick court shows 6 defaults precovid by healthymouth - calling her a "Borrower is a highly respected businesswoman from California" seems like a bit of a stretch

she was not paying or supposedly paying on a payment plan and her credit took a hit , all the rest seems like she said, he said . I hate funding circle with a passion but i do not really see anything crazy that did wrong

very Single MCA has either been fully paid or current in payments , Court Records wont show anything active debt or UCC liens if you can look for it

Buddy this merchant did not default because of an eye issue or covid. She took a bunch of loans on top of them ,with the intentions of lowering and defaulting on all of them. Funding circle should take her to the bank for every time she stacked on them and should make sure they get all the different bank accounts.I can tell you there is 10 plus , how many were you part of ?

I funded about 2 or 3 Advances for her About $350k and have helped pay off about 5 . The whole point of the Post is to follow what happens when Merchant vs Lender happens . No one is squeaky clean ever and Ill be interesting

She did pay the loan though
