    TCPA lawsuit follow-up

    Following up from my original post before Christmas holiday - To re-cap, I was served on 12/14/2020 a class-action lawsuit for violation of TCPA rules. Although I don't use an auto-dialer and had no record of ever speaking with the plaintiff(s) I still had to respond, which I did.

    The result was made known yesterday when the plaintiff's attorney filed a Notice of Voluntary Dismissal with the court. There was no financial settlement.

    I recently got sued by an individual for this, this is nothing more than ambulance chasing. Something needs to be done to stop these frivolous lawsuits.

    do yourself a favor. Throw it out, dont respond, dont acknowledge it, as others have said, this is ambulance chasing

    Pretty much yea, the same plaintiff has already filed 14 lawsuits this month!

    It's a win only because I'm a pathetically small, one-man shop. If they smelled money things could have been different - this is a business model for them which enriches the plaintiffs, attorneys and the courts. My fortunate result was because I became more trouble (cost) to them than their potential gains.

    I doubt you'll get much sympathy from the courts, they're making a killing in filing fees from these predatory plaintiffs. There's no incentive to stop them and we're the only targets - the actual companies that abuse TCPA (robo calls) have gotten very good at not being detected. Have you ever tried to call one back? The number that just called me doesn't even exist!

    Actually these guys make a killing, the one who sued me already has filed 15 new lawsuits this month X $402 filing fee and some boiler plate documents = a killing. If only half settle it's still a killing. I'd actually fund this MF lol!!!

    Unfortunately he's right. This one clown lawyer, Heidapour, has cleared a few million already since he started this, although last I heard he was facing issues threatening his ability to practice.

    Don't legally call them all day and make their phone lines too busy to try and sue people.
