ISO Accidently Sent A Commission - Will Not Return It

Anyone have any experience with this situation?

An ISO was sent a commission by accident that was supposed to be sent to another ISO and the ISO will not return it? At first the ISO was communicating, then now a ghost. Wasn't a tremendously large amount, but to end a relationship over this does not make sense. Have called, texted, emailed several times. No response now.

I have worked with Advance America in the past - never had any issues with them.

Seems like in the beginning you had communications going. as a strong advocate for ISO's and Brokers, my first conversation would be about send more deals and what do you feel is the best way to deal with the error?....and if he ran away you need to look at it like a merchant defaulted -- "Money has no memory" in a funding business where the loss came from either a merchant or an iso.

I've used him twice in the past to attempt to go after the commission clawback where the ISO was not cooperating. He'll charge a 25% contingency fee, but better than nothing.

Did you try offering him condoms?
You know a funder ain't funding **** if they can not reverse an ach and have to come on here to cry about a commission not being returned

Hold on....... wait just a second here.... you don't have the ability to reverse ACH's??? Or was this sent as a wire?
Most all lenders have that function I thought?

Option 1 (simplest option). Don't tell him anything. Encourage him to keep sending you deals. Fund something with him. Deduct the amount owed from the commission from the new deal.

Option 2. Just ACH the money back, it's not his.

I've seen it happen before. You're never going to see that money again. Swallow it and move on.

It's simple - File a claim/wire recall with your bank to try to pull the wire back as it was sent to an account in error, (they won't be able to get it back for you as its too late, but you want that wire recall request on paper) once you have proof of the complaint with your bank file Suit against the ISO and their owners (Since it's an ISO you work with you have the owners names, or at least should have the owners names) then pray for the best.

Use an MCA attorney if you're looking for aggressiveness, be ready to pay a 25% contingency fee. (If your attorney is aggressive enough he can collect the additional 25% in damages too)

You'll win the suit. question is if they'll pay once you win.
