Robotexting is in for a shakeup

If you rely on sending automated texts as part of your business, you probably noticed that some changes have been taking place over the last year, namely that all businesses have to be registered with The Campaign Registry in order to maintain compliance. But it's about to get more complicated.

The FCC is on the verge of instituting a new rule that would close the "lead generator loophole" in which a lead generation site or comparison shopping platform obtaining consent to send robotexts won't be able to confer that consent to all of their affiliated partners. Instead, according to the FCC, "the website may offer a consumer a check box list that allows the consumer to specifically choose each individual seller that they wish to hear from. Alternatively, the comparison shopping website may offer the consumer a clickthrough link to a specific business so that the business itself may gather express written consent from the consumer directly."
