I also know you were using data from Slate Advance. Be careful who you tell not to open their mouth because if I open it more it may hurt you, hence why I haven't. I've opened it 10% of the way. mhelman, you have never met me nor do you know my history. Our average deal and funding size is between 50m-75m. How realistic is it to have a sales floor calling lists at that point. It makes far more sense to operate a referral network with warm hand offs. The average broker see's what maybe one of these a month. There is no volume play for a sales floor to make any sense. We could with our smaller programs like the SBA, but with us looking at opening a fund in the next 30 days Midwestern will most likely be moving away from the majority of our smaller programs and focus more on private capital raising. That how ever is Midwestern, you obviously don't know my personal history. I started in the MCA space years ago, I won't name the Funder I worked for but I was on their brokerage side. I did half of the brokerages revenue personally. My average was 1-2m in closings personally, I opened and closed these deals. I closed million dollar plus MCA's with Ibex, 24, and a few others who's names I cant remember at this point as its been to long. I'm not proud of these deals, I'm not a fan of MCA's as a product but it's apart of my history and I gladly own it. We have no issue opening or closing transactions. Before you open your mouth about someone I highly recommend doing your research before opening your mouth. This is why I established my business as inbound only. We do no marketing to consumers outside of social media posting. 90% of our deal flow via our referral network the remaining 10% are applications on our website. The fact he can sue you after going through you application process is kinda messed up. If he had immediately filed a compliant sure, but he didn't. He chose to send in an application and he documentation as much as I dislike MCA's that's intent to take one out. I don't see how its fair he complains after the fact. If it was when you called sure, complain then, but not after putting an application in and getting to an underwriting call.

No data is scrubbed enough to avoid these issues. The only way to avoid this is to buy leads/data with affirmative consent still attached to it. What is that? We run ads, people apply on our site. the day they apply you have 90 days to contact them regardless of DNC for the services they opted in to learn more about, buying them in real time or within the 90 days gives you until that 90 days is up to call them. Lots of data companies will scrub vs screamer lists and DNC but you can still hit a landmine if you're not following the law which requires affirmative consent. and calling within those guidelines

I agree, but its almost always SMS violations, not DNC. Shortcuts have consequences.

The fact these guys make a living off of screwing telemarketers is very gross. People complain about mca being predatorial and you've got guys literally fishing for lawsuits w/ innocent people.

I apologize. Anthony Diamond is a man of integrity. Didn't know this was his company. I suggest anyone who wants to work with someone whose honest and knows his **** to reach out to him. He was TVT's head uw to you newer guys. The man is not only sharp and a beast but he's honest which is hard to come by in this spacs.

Agreed, any real ISO has at least had an interaction of some sort on this matter. Harvest your own data to turn into leads and understand how to scrub and appropriately market to it and all is well.

Im sure his sales will go up, nothing fires you up more then knowing you're going to get sued. There's a bright side to all situations. A valuable lesson was learned here. This is a good opportunity for some lead generator to respond about how their data is scrubbed well. This is why reliable lead sources are necessary if you are an iso. Sorry Speedy.. The world is full of predators. Hopefully this guy gets what's coming to him.

I price the deal, fund it, and add the iso on the bank stmts to my excel for marketing to add them to my email blasts. Aquamark has increased the amount of isos I sign up. It's good marketing for us.

These guys hit the owners, sales reps etc as well. Killing the company wont fix that. If I understand right, the "merchant" applied, worked process, while gathering parties the whole way. OP is screwed.
